Please read these Terms of Service ("Terms") carefully before using BactiFIND (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
BactiFIND is an educational and reference application for microbiology and clinical laboratory topics, including: - A Biochemical Tests Library (e.g., Catalase, Oxidase, Indole, Coagulase, ONPG, Nitrate Reduction, and related assays) - Organism Search & Identification tools - Organism Comparison / Differential Test tables - Grading and scoring calculators (e.g., Bartlett's Scoring, Murray-Washington Criteria) - PubliFIND, an optional feature allowing users to draft and share written content via their device's messaging or email apps
The App is intended for students, educators, laboratory professionals, and healthcare workers for learning and reference purposes only.
The App is not a medical device and does not provide medical, diagnostic, or clinical advice. Content such as biochemical test interpretations, organism identification criteria, and grading scales reflects general educational material and must not be used as the sole basis for diagnosing, treating, or making clinical decisions about any patient or specimen.
You are solely responsible for verifying any information against current, accredited laboratory protocols, institutional guidelines, and the judgment of qualified professionals before relying on it in any real-world clinical, academic, or laboratory setting. We disclaim all liability for outcomes resulting from reliance on App content in place of professional protocols.
The App is intended for users who are students, educators, or professionals in health sciences fields. It is not directed at children under 13, and by using the App you represent that you meet this requirement or are using it under appropriate institutional/parental supervision if required by your jurisdiction.
When using the App, you agree that you will: - Use the App only for lawful, educational, and reference purposes - Not attempt to reverse-engineer, decompile, or extract the App's underlying content database for redistribution or commercial resale - Not misrepresent App-generated reference material as validated clinical or diagnostic results - Provide accurate information if you choose to use optional features like PubliFIND - Not use the App to transmit unlawful, harmful, or infringing content through features such as PubliFIND's messaging/email functions
PubliFIND allows you to enter text (e.g., a name, contact details, title, and written content) and send it via your device's native Messages or Email application. This feature is provided for convenience only. We do not review, store, or take responsibility for the content you choose to send using this feature, and any communication sent is your responsibility as the sender.
All content within the App — including but not limited to the organism database, biochemical test descriptions, grading criteria, diagrams, text, and software — is owned by us or our licensors and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, educational purposes only. You may not copy, modify, distribute, sell, or lease any part of the App's content without our prior written consent.
Certain reference content is stored locally on your device to support offline use. We may update, correct, or modify this content periodically to reflect current microbiology standards. We do not guarantee that offline content will always reflect the most current version until you update the App.
The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App's reference content is free of errors or omissions, or that it will meet your specific educational or professional requirements.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from or related to your use of, or inability to use, the App — including any reliance on biochemical, organism identification, or grading content for clinical or diagnostic purposes. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount, if any, you paid to use the App.
The App may integrate with your device's native Messages or Email applications (via PubliFIND) or third-party analytics/crash-reporting services. We are not responsible for the practices, availability, or content of these third-party services, which are governed by their own terms and privacy policies.
We reserve the right to suspend or terminate your access to the App at any time, without notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the App, other users, or third parties.
We may revise these Terms from time to time. Material changes will be reflected by an updated "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
